Terms of Use

The short version

  • Your entries are yours. We only store and show them back to you.
  • Simply Kind Plus is an optional auto-renewing subscription, billed through the App Store or Google Play. Cancel anytime in your store settings.
  • Simply Kind is a reflection tool, not medical or mental-health advice.
  • You can delete your account — and everything in it — anytime.

Agreeing to these terms

These terms are an agreement between you and Michelle Hardi, a sole trader based in Melbourne, Australia (“we”, “us”), covering the Simply Kind mobile app and this website (together, the “Service”). By creating an account or using the app, you agree to them. If you don't agree, please don't use the Service. Our Privacy Policy explains how we handle your data and forms part of these terms.

Who can use Simply Kind

You need to be at least 13 years old to use Simply Kind. If you're under 18, please make sure a parent or guardian is okay with you using the app and with these terms.

Your account

You sign in with your email address and a one-time code — there are no passwords. Keep access to your email account secure, because anyone who can read your email can sign in as you. You're responsible for activity that happens under your account. If you think someone else has accessed it, contact us at hello@michellehardi.com and we'll help.

Your content

Everything you write in Simply Kind — intentions, reflections, gratitude notes, mood ratings, monthly check-ins — belongs to you. You give us permission to store and process it only as needed to run the Service: saving your entries, syncing them to your devices, and showing your own history and insights back to you. We never use your entries for advertising, never sell or share them, and never use them to train AI models.

You can export your entries or delete your account (which permanently erases everything) at any time from Settings in the app.

Fair use

When using the Service, you agree not to:

  • break the law, or use the Service to store unlawful content;
  • interfere with, overload, or attempt to gain unauthorised access to the Service, its servers, or other people's accounts;
  • copy, resell, reverse-engineer, or misrepresent the Service as your own;
  • use the Service to harm yourself or others.

Free plan and Simply Kind Plus

The free plan

The daily ritual is free, with your most recent seven days of entries in view. Older entries are kept safely — upgrading brings your full history back.

Simply Kind Plus subscriptions

Simply Kind Plus is an optional subscription that unlocks your full history and Plus features. It's offered as a monthly or yearly auto-renewing subscription. The price is shown in the app before you buy and is charged to your Apple App Store or Google Play account when you confirm the purchase.

  • Auto-renewal — your subscription renews automatically at the end of each period unless you cancel at least 24 hours before the current period ends.
  • Cancelling— manage or cancel anytime in your App Store or Google Play subscription settings. Deleting the app does not cancel a subscription. When you cancel, Plus stays active until the end of the period you've paid for.
  • Refunds — payments are processed by Apple or Google, so refund requests go through them, subject to their policies and your rights under the Australian Consumer Law.
  • Price changes— if a subscription price changes, you'll be notified through the store before it applies, and you can cancel before the new price takes effect.

Not medical advice

Simply Kind is a journalling and reflection tool. It is not a medical device, therapy, or a substitute for professional mental-health care, and its insights — mood trends, streaks, gratitude themes — are gentle observations, not diagnoses. Our content

The Simply Kind name, design, and everything in the app that isn't your content belongs to us. We give you a personal, non-transferable licence to use the app on devices you own, for your own use, under these terms and the rules of the app store you downloaded it from.

Availability and changes

We work hard to keep Simply Kind running smoothly, but it's made by a very small team and we can't promise it will always be available or error-free. We may add, change, or remove features over time. If we ever discontinue the Service or a paid feature, we'll give you reasonable notice and the chance to export your entries.

Ending things

You can stop using Simply Kind and delete your account at any time from Settings. We may suspend or close accounts that seriously or repeatedly break these terms — where reasonable, we'll warn you first and give you the chance to export your entries.

Liability

Nothing in these terms excludes rights you have under the Australian Consumer Law or other laws that can't be excluded, including consumer guarantees that services be provided with due care and skill. Beyond those rights, the Service is provided “as is”, and to the extent permitted by law we're not liable for indirect or consequential loss. Where liability can't be excluded but can be limited, it's limited to re-supplying the Service or the amount you paid us in the 12 months before the claim.

App store terms

If you downloaded Simply Kind from the Apple App Store or Google Play, their terms also apply. Apple and Google aren't responsible for the app or these terms, don't provide support or maintenance for it, and are third-party beneficiaries of these terms with the right to enforce them against you.

Changes to these terms

If we change these terms in a way that matters, we'll update the date at the top and let you know in the app before the changes apply. Continuing to use Simply Kind after that means you accept the updated terms.

Governing law

These terms are governed by the laws of Victoria, Australia, and any disputes belong to the courts of Victoria — without limiting any consumer protections you have where you live.
